For recordings, we've collected the current issues that may arise when dealing with different states and counties.

Below is the list of the Northeastern states and their

special requirements.

Connecticut: Real Estate documents are recorded at the city/town level. MERS documents have an additional fee to record. Some Deeds require an OP-236: link to OP-236.

Delaware: Kent charges a $10 rejection fee, which the county has said cannot be paid electronically. Rejections must be sent via paper to the county with a check for rejection fees.


Maine – Has a conveyance form for Deeds: link.


Maryland: Most counties require an intake sheet be filled out for the treasurer on Deeds and Mortgages. Land Intake Sheet (mdcourts.gov) Does not currently eRecord


Massachusetts: Has Registered Land and Recorded Land – Registered Land will have a certificate number in the legal description.


New Jersey: Deed forms GIT/REP -3 – Seller’s Residency Certification/Exemption – For In-State Seller OR non-resident that qualifies for an exemption for the estimated tax payment required of non-resident sellers. GIT/REP-1 Required if non-resident and not tax-exempt; deeds are typically not eRecordable with this form.

All counties in NJ require cover pages. When eRecording, the cover page is automatically generated from indexing in ePrepare once the package is submitted to the county.


New Hampshire: $25 LCHIP fee applies to Deeds, Mortgages, and full discharge of mortgage, in addition to recording fees. Deeds have forms CD-57-P and PA-34 that are submitted to DOR once the deed is recorded within 30 days.


New York: The state is costly to record, with the four NYC boroughs being the most expensive tax-wise.

Deeds require RP-5217 and TP-584 documents; depending on the county and information in the Deed, more may be required. NYC boroughs require the ACRIS system to be used to create the tax forms and will generate a Tax Transaction number required to create a cover page for the Deed in the ACRIS system.

Westchester requires you to use their PREP system for Tax Transactions. Mortgage recordings are taxed.

Nassau County requires all documents to be submitted with 1 Tax Map Verification letter per block in the S/B/Ls in the document. This currently costs $355 to obtain.

Suffolk has a cover page and is currently recording documents from early August.


Pennsylvania: Parcel Identification is required on all documents, and most counties require a legal description. The font size minimum is 12 pt for letter-size documents and 14 for legal size.

Some counties charge a $10 rejection fee per document. Philadelphia deeds also have a Philadelphia real estate transfer tax certification form.


Rhode Island: Deeds are $80 + tax on non-exempt deeds, Mortgage $60, release, and assignment $45. Documents are recorded at the city/town level.


Vermont: Is not available to eRecord in ePrepare, records documents at the city/town level. Deeds have a form, and taxes are submitted directly to the state Department of revenue unless exempt from taxes, the form can go to the recorder.
