For recordings, we've collected the current issues that may arise when dealing with different states and counties.

Below is the list of the South Eastern states and their

special requirements.

California: Requires COI (Certificate of Insurance) to Record. California is very particular about the top 2.5” of the document meeting margin requirements.

Those requirements are the following: On the left, it must have 5” of blank space & on the right 3”.

California has "requested by" and "return to" statements.

The deed form is PCOR, some counties require it, and some allow you to record without it for a $20 fee.


Colorado: Deed of Trust always has the county's Public Trustee as the Trustee. They have a specific Deed of Trust release form, which the Public Trustee signs in addition to the lien holder releasing the Deed of Trust.


Idaho: Deed of Trust must be released by a Trustee. Deeds do not have a tax.


Montana: Deeds have a conveyance form: here is a link to the Realty Transfer Certificate.


Nevada: Has a declaration of value for deeds: link to the declaration.


Oregon: No recording tax on any documents. Deeds appear to be $86 base + additional page fees, except in Washington County, which has a recording tax on deeds.


Washington: Strict first page and margin requirements. If margins on all but page 1 are not 1” all around, an emergency cover page can be completed and signed, and for an additional page fee of +$53, the document can be recorded: link to the emergency cover page.

The Emergency cover page has space for all the first page's required information.

Deeds have excise tax to record and must include the eReet: Real estate excise tax forms found here: link.

If a document has a legal description, an abbreviated legal is required on the first page.


Wyoming: There is no transfer tax to record deeds, does have a deed form: link.
